Overview

Welcome to Stay At Home Spark! “We,” “us,” and “our” refer to Stay At Home Spark. We operate stayathomespark.com, including its content, features, products, and related services (the “Services”). Our store is powered by Shopify.

These Terms of Service, together with our published policies, govern your use of the Services and purchases from our store. By using the Services, you agree to these Terms. Our collection and use of personal information are described in our Privacy Policy, available through the website’s policy links.

1. Access and accounts

To place an order, you must be at least the age of majority where you live or act with the permission and supervision of a parent or legal guardian.

You agree to provide accurate, current billing, payment, shipping, and contact information. You must be authorized to use the payment method submitted.

You are responsible for protecting your account credentials and notifying us if you believe someone has accessed your account without permission.

2. Our products

Stay At Home Spark offers individually 3D printed products, including articulated animals, miniature figures, and other printed creations.

Visible layer lines, minor surface variations, and slight differences between prints are normal characteristics of 3D printing. Product colors may appear different depending on lighting and screen settings.

Rainbow, gradient, and multicolor filaments produce variable color placement. Unless a listing expressly promises a particular arrangement, each item’s color pattern may differ from listing photos.

Product listings describe the item, quantity, size, and available options. Props and display accessories are not included unless expressly stated. Measurements are approximate unless otherwise specified.

These normal variations do not excuse defects, missing pieces, or products that materially differ from their descriptions. Eligible returns are handled under our Return & Refund Policy.

We may update listings, limit quantities, or discontinue products. Changes do not alter the agreed specifications of an already accepted order without your agreement.

3. Product safety and care

WARNING: CHOKING HAZARD — Small parts. Not for children under 3 years.

Miniature products and pieces that detach or break may present a choking hazard. Keep them away from children under 3 and pets. Follow the age guidance and warnings provided with each product. Adult supervision is recommended when children handle products.

Do not place products in the mouth or use them as teething items. Unless expressly identified for that purpose, products are not intended for food contact, medical use, or safety-critical applications.

Handle articulated joints gently. Do not force joints beyond their natural range of movement or pull pieces apart.

Keep printed products away from excessive heat, hot vehicles, flames, dishwashers, and prolonged direct sunlight. Heat can soften or deform printed plastic. Clean gently with a soft cloth and, when needed, cool water and mild soap.

Stop using any product that breaks, develops sharp edges, or releases loose pieces. Contact us if you believe the damage resulted from a manufacturing defect.

These instructions do not limit your rights concerning defective or unsafe products.

4. Orders and cancellations

By placing an order, you offer to purchase the selected products. We may decline or cancel an order because of unavailable inventory, suspected fraud, payment issues, an obvious listing error, or another legitimate reason.

An automated order receipt confirms that we received your order; acceptance occurs when we confirm acceptance or dispatch your order.

If we cancel a paid order, we will notify you and refund the amounts paid for the canceled items, including applicable taxes and shipping charges where appropriate.

Please review your selections and shipping address before checkout. To request a change or cancellation, email thestayathomespark@gmail.com as soon as possible. Changes may not be possible once production, personalization, packing, or shipment has begun.

Any cancellation rights required by law remain available.

5. Prices, payments, and promotions

Prices are displayed in the currency shown at checkout. Applicable taxes, shipping, and handling charges are displayed before you complete your purchase.

Prices and promotions may change, but changes do not retroactively alter an accepted order.

Discount codes and promotions are subject to their stated conditions, including expiration dates, minimum purchases, exclusions, and limits on combining offers.

For international orders, any customs duties, import taxes, or clearance charges not collected at checkout may be payable by the recipient, subject to applicable law and the terms shown before purchase.

6. Shipping and delivery

Available shipping methods, charges, and any stated processing times are shown on our website or at checkout. Processing time and carrier transit time are separate.

Carrier delivery dates are estimates unless we expressly offer a guaranteed service. Weather, carrier disruptions, customs processing, and other events may affect delivery.

If we cannot ship within the promised timeframe, we will notify you and provide the delay or cancellation options required by applicable law. If an order is canceled because we cannot ship it, we will issue the required refund promptly.

You are responsible for providing an accurate delivery address. If an incorrect or incomplete address causes a package to be returned, additional shipping charges may apply before reshipment.

If your package is missing, damaged, or marked delivered but cannot be located, contact thestayathomespark@gmail.com promptly. We will review the issue and work with you and the carrier toward an appropriate resolution. Handing a package to a carrier does not eliminate our obligations under applicable law or our published policies.

7. Returns, refunds, and exchanges

Our published Return & Refund Policy, available through the website’s policy links, explains eligibility, deadlines, return shipping responsibilities, exclusions, and refund processing.

Please contact us before mailing a return. Personalized products and items made to your specific requirements may be excluded from change-of-mind returns, as described in that policy.

Return exclusions do not remove your rights concerning damaged, defective, or incorrect products.

8. Intellectual property

Our branding, original photographs, written content, and other original website materials belong to Stay At Home Spark or their respective owners.

Some products are printed from designs created by independent designers and used under applicable commercial licenses. Purchasing a physical product does not transfer ownership of the underlying design, grant access to its digital files, or provide permission to reproduce it.

Designer names, trademarks, and credited designs remain the property of their respective owners.

You may use the website for browsing, shopping, and other lawful purposes. You may not copy our original content or use our branding in a way that infringes intellectual property rights or suggests an unauthorized affiliation.

9. Relationship with Shopify

Stay At Home Spark is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Stay At Home Spark. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Stay At Home Spark, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Stay At Home Spark.

10. Privacy and third-party services

Our handling of personal information is described in our published Privacy Policy.

Shopify and service providers may process information needed to operate the store, process payments, fulfill orders, prevent fraud, and provide other services. Their processing may also be governed by their own privacy policies.

Our website may link to third-party websites or offer third-party tools. Those services are subject to their providers’ terms. We are not responsible for independent third-party content or services, except where applicable law provides otherwise.

11. Reviews and customer submissions

You are welcome to submit honest reviews and feedback, whether positive or negative.

You retain ownership of content you submit. When you submit a review, photo, or other content through our public review features, you grant us a nonexclusive, worldwide, royalty-free license to display and reproduce it in connection with the store and promotion of our products.

Private customer-service messages are not treated as permission to publish your personal information or use your image in advertising.

You must have permission to submit the content and must not include unlawful material, another person’s private information, or content that infringes another person’s rights. Disclose any incentive or compensation associated with a review.

We may remove spam, unlawful content, personal information, or content unrelated to the product. We do not prohibit honest criticism.

12. Errors and corrections

We may correct typographical errors or inaccurate information involving prices, descriptions, availability, or shipping charges.

If an error materially affects an order, we will contact you to explain the issue and offer an appropriate correction or cancellation and refund. We will not charge an increased price without your agreement.

13. Acceptable use

You may not use the Services to:

• Commit fraud or violate applicable law.
• Infringe intellectual property or privacy rights.
• Threaten or harass another person.
• Submit false order or payment information.
• Send spam or upload malicious software.
• Access accounts or systems without authorization.
• Bypass security measures or disrupt the store’s operation.

Automated tools may not circumvent security controls, misrepresent their identity, collect personal information without authorization, or place orders without the purchaser’s permission.

We may restrict access or suspend accounts where reasonably necessary to address misuse. This does not remove our obligations concerning existing orders or refunds.

14. Warranties and consumer rights

We aim to provide accurate descriptions and products that match the specifications agreed at purchase.

Except for express promises we make and rights required by applicable law, we do not provide additional warranties concerning uninterrupted or error-free website access.

TO THE EXTENT PERMITTED BY LAW, IMPLIED WARRANTIES ARE DISCLAIMED EXCEPT WHERE THEY CANNOT LAWFULLY BE EXCLUDED. NOTHING IN THESE TERMS EXCLUDES MANDATORY PRODUCT WARRANTIES, OUR EXPRESS COMMITMENTS, OR REMEDIES AVAILABLE UNDER CONSUMER LAW.

15. Limitation of liability

To the extent permitted by law, Stay At Home Spark is not liable for indirect or consequential losses, including lost profits or business opportunities, arising from use of the Services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, or personal injury where applicable law prohibits such a limitation.

These Terms do not eliminate your right to a refund, replacement, or other remedy required by law or expressly provided in our policies.

16. Governing law

These Terms are governed by the laws of the State of Texas and applicable United States federal law, without overriding mandatory consumer protections that apply where you live.

Where legally permitted, disputes may be brought in courts with appropriate jurisdiction in El Paso County, Texas. This provision does not restrict any right you have under applicable law to bring a claim elsewhere.

17. Severability and waiver

If a provision is found unenforceable, the remaining provisions will continue to apply.

A failure to enforce a provision on one occasion does not waive the right to enforce it later.

18. Changes to these Terms

We may update these Terms by posting a revised version on this page and providing any notice required by law.

Changes apply prospectively and do not retroactively reduce rights associated with an existing purchase. Continued use of the Services after an update takes effect constitutes acceptance to the extent permitted by law.
